2023: Compel Falz, Aisha Yesufu To Run For President, Vice-President Respectively – Man Asks Court

A young man, Emmanuel Idris Yakubu has urged the Federal High Court, Abuja to compel activists, Aisha Yesufu and Folarin Falana (Falz) to run for President in the forthcoming general elections.

Falz is also a popular Nigerian artiste.

The applicant, in the summons signed by his counsel, Ojong Miller, prayed the court to determine the eligibility of the activists to run for President.

Yesufu and Falz are to appear before the Federal High Court, Abuja within 14 days of the service of the summons.

The summons with suit number CV / 2743/21 was brought in pursuant to order 2 rule 3 of the high court of FCT Abuja (civil procedure) rules 2018, sections 130, 131, 132, 141 and 142 of the 1999 Nigerian constitution (as amended).

It reads: “Let the following respondents: (1) Folarin Falana (A.K.A Falz, A.K.A Falz. Thebadguy) and (Ii) Aisha Yesufu attend the High Court Of The Federal Capital Territory, Abuja within Fourteen (14) days after service of this summons on them, inclusive of the day of such service, cause an appearance to be entered for it and/or them to this summon which is issued upon the application of the (Applicant) Emmanuel Idris Yakubu (a.k.a BOBMANNY) who claims reliefs from this Honourable Court against the Respondent and praying the Honourable Court for the determination of the following questions:

“Whether the Respondents have shown true leadership in the way they have galvanized Nigerian youths to speak in one voice on issues of National interest, especially before, during and after the nationwide protest against police brutality tagged #ENDSARS?

“Whether the Applicant having keenly followed the activities of the Respondents for many years, and like the majority of Nigerians both at home and in the diaspora, is convinced that they have indeed displayed consistency in their quest for the actualization of a better Nigeria for the benefit of the next generation of Nigerians, can rightly bring this application before this Honourable Court?

“Whether the Respondents are eligible to contest for the office of President and Vice President respectively in line with the provisions of the 1999 Constitution of the Federal Republic of Nigeria?

“Whether the 1st and 2nd Respondents being eligible to contest for the office of President and Vice President respectively by virtue of the 1999 Nigerian constitution and being generally accepted by the majority of Nigerians ought not to be compelled to contest for the office of President/Vice President?

“The Applicant hereby seeks against the Respondent the following reliefs: 1. An Order compelling the 1st and 2nd Respondent to contest for the office of President and Vice President respectively in the forthcoming 2023 Nigerian presidential election.

“It will not be necessary for you to enter appearance in the High Court of the Federal Capital Territory, Abuja Registry, but if you do not attend either in person or by your legal practitioner, at the time and place above mentioned (or at the time mentioned in the endorsement thereon), such order will be made and the proceeding taken as the Judge may deem just and expedient.”
