Executive Order 10: Supreme Court Rules Against Buhari As Governors Win

The Supreme Court ruled on Friday that President Muhammadu Buhari’s executive order 10 was illegal and unconstitutional.

According to Anaedoonline.ng, six of the seven members of the Supreme Court panel decided against the executive order, giving the state governors success in their challenge against the President’s statement.

By its decision, the Supreme Court has overturned Executive Order 10, popularly known as the Financial Autonomy Order.

The directive is for the implementation of Financial Autonomy for the State Legislature and Judiciary, according to this internet platform.

According to the directive, President Buhari aims for the legislative and judicial branches of government in the 36 states of the federation to no longer rely on state governors for funding.

The President said that his decision was based on Section 5 of the Federal Republic of Nigeria’s 1999 Constitution (as Amended).

The order has now been declared void by a Supreme Court decision issued on Friday, in which six of the seven justices ruled unanimously that it was not the Federal Government’s responsibility to fund the capital and recurrent expenditures of the superior courts established for States under Section 6 of the Constitution.

The decision is based on a lawsuit brought by 36 states against the FG over judicial financing and the validity of the EO10.

President Buhari had previously ordered the suspension of publication of Executive Order 10 in the Federal Government’s Official Gazette in the aftermath of the order’s controversy.

The publishing of Executive Order 10 would have signaled the start of the Order’s implementation.

After meeting with members of the Nigeria Governors’ Forum (NGF), led by its Chairman, Governor Kayode Fayemi of Ekiti State, President Buhari reportedly halted publishing to provide additional time for proper deliberations among stakeholders.

Members of the NGF had also confirmed the postponement of the publication at their 10th teleconference on COVID -19 held back in June 2020.
