On Monday, Justice Inyang Ekwo of a Federal High Court in Abuja declined to compel the Federal Government to release Abba Kyari, a detained Deputy Commissioner of Police, from the National Drug Law Enforcement Agency’s custody.

Rather, the judge ordered Kyari to notify the Federal Government of the existence of the lawsuit he had filed against it.

The federal government had been sued by the suspended officer, who was fighting his ongoing custody by the NDLEA in court.

Kyari, who is being held by the NDLEA for his alleged involvement in a narcotics trade, petitioned the court for an order to free him immediately and to be released to bail with liberal terms in the FHC/ABJ/CS/182/22 lawsuit.

Kyari claimed in an ex parte motion presented by his attorney, Cynthia Ikena, that he was suffering from severe diabetes that was endangering his life and that he required immediate medical treatment.

In a quick judgement, Justice Ekwo declined to order his immediate release, but did order him to notify the respondent.

The judge also ordered him to go serve all of the federal government’s procedures that he had filed.

All of the averments and charges leveled against the Federal Administration were so serious, according to Justice Ekwo, that the court had to give the government a chance to respond before taking any action.

He scheduled the parties to appear before him on Thursday.
