Malami Ordered To Delete Section 84(12) In Electoral Act By Court

On Friday, the Federal High Court in Umahia, Abia State, ordered Abubakar Malami, the Minister of Justice and Attorney-General of the Federation, to delete Section 84 (12) of the modified Electoral Act.

While urging the minister to remove the clause from the Electoral Amendment Act, Justice Evelyn Anyadike pointed out that it is illegal.

Section 84 (12) is unconstitutional, invalid, illegal, null, void, and of no consequence, according to Anyadike, and should be thrown down because it is in contravention of the Constitution’s unambiguous requirements.

Malami was ordered by the judge to “immediately erase the abovementioned Subsection 12 of Section 84 from the body of the Electoral Act, 2022.”

President Muhammadu Buhari’s request to have that portion of the modified Electoral Act deleted was recently denied by the 9th Senate.

When the president’s request was tabled for a second reading, the parliamentarians rejected it by voice vote.

President Buhari argued that Section 84 (12) of the Electoral Act violated the Constitution and violated the rights of government appointees after signing it.
