REVEALED: Why Justice Ekwo Struck Out Umahi’S Motions For Stay Of Execution

Roy Nwaze, the Ebonyi State Governor’s elder brother and the state government’s counsel, explained why David Umahi and his deputy Eric Kelechi Igwe’s requests for a stay of execution were dismissed by Justice Inyang Ekwo of the Federal High Court in Abuja on Monday.

Nwaze was reacting to a Federal High Court judge’s decision allowing governor Umahi’s attorney to drop the application for stay of execution.

“The current situation is simply that the records of the appeals filed by Governor Umahi (and his Deputy) and members of the House of Assembly have been transmitted to the Court of Appeal, Abuja, and the appeals have been lawfully lodged in that Court as Appeal Nos 274 and 275,” he said.

Umahi’s Sack: Court REJECTS Stay Of Execution Request

According to investigations, inhabitants of Ebonyi State were ecstatic over the motions being struck down, mistaking it for a denial of Umahi’s bid for re-election.

“The appeals having been entered in the Court of Appeal, the Federal High Court, from which the appeals arose, ceased to have jurisdiction to entertain any issue relating to the instances that it had heard,” Nwaze said.

“What, therefore, simply happened in the Federal High Court today was that the counsel for Gov Umahi and the House of Assembly members informed the Court that the appeals have been entered in the Court of Appeal.

“He applied to withdraw the motions for stay of execution because new ones have also been filed in the Court of Appeal. Anything else that people are reporting is as a result of ignorance” he stated.
