Anambra Election: Supreme Court Reveals Why Andy Ubah’s Candidacy Was Nullified

The Supreme Court has ruled that the disqualification of Andy Uba, the All Progressives Congress (APC) governorship candidate, in the November 2021 Anambra governorship election was correct.

According to Anaedoonline.ng, the apex court said this in a ruling issued on Tuesday.

The Supreme Court found that the APC governorship primary that produced Uba was illegitimate and unconstitutional in a unanimous judgement by a five-member panel of Justices.

The supreme court went on to say that because the primary was held unlawfully and in violation of the party’s standards, Uba’s candidacy was suspect and illegitimate.

Remember that a candidate in the APC primary election, George Moghalu, went to the Federal High Court to challenge the primary’s procedures and outcome.

Moghalu requested N122.5 million in damages, N100 million “for the violation of contract to begin and end primary election,” and a refund of the fee paid for expressions of interest and nomination forms in a lawsuit filed before the court.

Justice Inyang Ekwo, the presiding judge, declared in December 2021 that Uba was never a candidate in the election after emerging from the APC’s fraudulently held primary election.

According to Ekwo, the plaintiff, George Moghalu, was successful in showing that the APC did not have a lawful primary election in which Uba claimed to have won the party’s flag bearer election on November 6, 2021.

Consequently, the presiding judge ordered the Independent National Electoral Commission (INEC) to delete Uba’s name from its record as a candidate in the election.

Dissatisfied with the ruling, Uba approached the Court of Appeal sitting in Abuja, to declare him as the governorship candidate of the All Progressives Congress (APC) in the Anambra election.

In a judgement delivered on February 23, the appeal court dismissed the appeal filed by Uba and upheld the judgment of the Federal High Court which dismissed his candidacy as the APC flagbearer in the poll.

The ruling delivered by Justice Danlami Zenchi dismissed the appeals brought by Andy Uba and the APC against the judgment of the trial court for lack of merit.

The decision of the appeal court was upheld by the Supreme Court on Tuesday.
