JUST IN: Appeal Court Reveals Verdict On Section 84(12) Of Electoral Act 2022

The provision of Section 84(12) of the Electoral Act 2022 has been decided by the Court of Appeal in Abuja.

The provision of Section 84(12) of the Electoral Act 2022 was nullified by the Federal High Court in Umuahia, according to Anaedoonline.ng.

The appeal court on Wednesday overturned a lower court verdict in Umuahia that had nullified the provision of the contentious portion of the Electoral Act.

The lower court lacked jurisdiction to hear the matter, and the action lacked merit, according to a unanimous finding by a three-member panel of the court led by Justice Hamma Akawu Barka.

The clause is illegal, according to the appeal court, since it breaches Section 42 (1)(a) of the Constitution and denies a class of Nigerian citizens their right to vote.

The plaintiff, Nduka Edede, lacked locus standi to submit the complaint in the first place, according to the court of appeal, which dismissed the case filed in Umuahia.

The appeal court went on to say that Edede had not shown any cause of action to justify his petition to the court since he had not shown that he was personally impacted by the provision.
