The complaint brought against the Attorney-General of the Federation, Abubakar Malami, and the Independent National Electoral Commission by the Governor of the Central Bank of Nigeria (CBN), Godwin Emefiele, has been dropped.

A notice of discontinuance has been issued and served on the defendants in the case, according to the attorney for the CBN governor, S.T. Maliki.

Maliki acknowledged this immediately after the issue was called on Monday.

Despite the fact that the case was set for a hearing, Emefiele told them to drop the complaint.

Maliki said, “Under the instruction of the plaintiff (Emefiele), we filed a notice of discontinuance dated and filed May 16, 2022.

“And the said notice of discontinuance was served on all the defendants on that said date of May 16, 2022, which proof of service is before your lordship.”

Only the 4th and 5th defendants submitted a counter-affidavit in response to the plaintiff’s modified originating summons after the notice of withdrawal was served on them, according to the lawyer.

He asked the court to dismiss the case and issue an order striking it out since the parties in the lawsuits had not joined the issues, citing Order 50 of the court’s regulations.

Although the 4th defendant’s counsel, John Aikpokpo-Martins, disputed Emefiele’s decision to drop the complaint, he requested the court to dismiss it for N1.5 million.

Chris Nevo and T. J. Adi, lawyers for the second and third defendants, respectively, did not object to the withdrawal notice.

For Nevo, he asked the court to award an N1 million cost against Emefiele.

Justice Mohammed in his ruling held that Emefiele had the right to file the notice of withdrawal.

He said the notice of discontinuance was valid and accordingly struck out.
