The alleged culpable murder action brought against Peter, the late gospel singer Osinachi Nwachukwu’s spouse, was dismissed by the Federal High Court in Abuja on Monday.

Justice Njideka Nwosu-Iheme issued an order allowing the defendant’s attorney to represent him.

Aderonke Imana, the prosecution’s lawyer, notified the court on Monday that they were ready to proceed with the case.

Peter’s lawyer, Victor Abakpa, appealed with the court to postpone the case until Tuesday, citing the fact that another lawyer from a different chamber had just told the court that he would be taking over the case.

The defendant’s new attorney indicated that he was also served further proof of evidence in the court just before the day’s proceedings began.

I.A Aliyu, the new attorney, indicated that the defendant informed him on taking over the case on June 18th.

As a result, the court adjourned the hearing until 11 a.m. to allow attorneys to properly align themselves and appear before the court.

The offense he allegedly committed, according to the accusation, is in violation of Sections 104 and 379 of the Administration of Criminal Justice Act (ACJA) 2015, Section 221 of the Penal Code, and the Violence Against Persons Prohibition Act (VAPP) 2015.

“This was caused by your various acts of violence and aggravated assault with the knowledge that her death would be the probable consequence of your act.

“Particulars of offence: That you, Peter Nwachukwu, male, sometime between Nov. 14, 2009, and April 2022 at Aco Estate, opposite Police Station, Lugbe, Abuja, FCT, within the jurisdiction of this court, did commit an offence to wit: emotional, verbal and psychological abuse on Mrs Osinachi Nwachukwu (deceased).

“This was caused by humiliating her and making utterances like ‘you are smelling,’ ‘you are mad,’ to her in the presence of her music crew members.”
