Osun 2023: Court Dismisses Suit Seeking APC, Oyetola’s Disqualification

An application to disqualify the All Progressives Congress, APC, and Governor Gboyega Oyetola from the next Osun State governorship election was denied by an Abuja Federal High Court on Thursday.

APC Chieftain Moshood Olalekan Adeoti, the plaintiff, utterly failed to disclose any cause of action, according to Justice Inyang Eden Ekwo, who dismissed the case on six grounds.

The judge ruled that the former gubernatorial candidate’s lawsuit was a flagrant abuse of the legal system and that the plaintiff failed to use all available internal channels before rushing to court.

Justice Ekwo supported Olusegun Jolaawo SAN’s claims that Governor Oyetola’s membership in the APC’s Caretaker Extraordinary and Convention Planning Committee (CECPC), the subject of the lawsuit, is an ad hoc group rather than the actual APC position recognized by the party’s Constitution.

Adeoti had asked for Gboyega Oyetola, the incumbent governor, to be disqualified from running for governor.

The governor participated in the February 19 primary election as a member of the APC’s National Caretaker Extraordinary and Convention Planning Committee, and he pleaded with the court to invalidate Oyetola’s candidacy in the original summons (CECPC).

The complainant claimed that the act was in violation of both Article 31(iii) of the APC, October 2014 and Section 222 of the Federal Republic of Nigeria 1999 Constitution (as amended).

However, the judge ruled that the CECPC is merely an ad hoc body established in the absence of the National Executive Committee as required by law and not a position recognized by the APC Constitution for which anyone can be disqualified.
