Strike: Court Hears ASUU’s Appeal Today

Today, the Academic Staff Union of Universities (ASUU) hopes to have its appeal of the National Industrial Court’s decision heard by the Federal Capital Territory’s Court of Appeal (Tuesday).

Remember that the Industrial Court ordered the lecturers to resume work pending the outcome of a lawsuit the Federal Government filed to challenge the validity of their strike in its ruling.

The order, according to Justice Hamman Polycarp, was both in the best interests of the nation and of the undergraduates in the nation who had been staying at home since February 14.

According to him, public university students who couldn’t afford to attend private postsecondary institutions suffered as a result of the strike action.

On September 23, 2022, ASUU, through its attorney Femi Falana, filed a 14-ground appeal against Justice Polycarp’s decision (SAN).

According to the union’s appeal, Justice Polycarp “erred in law and occasioned a miscarriage of justice when he decided to hear and determine the respondents’ motion for an interlocutory injunction when he knew or ought to have known that the substantive suit was not initiated by due process of law.”

ASUU added that under sections 17 and 18 of the TDA, the NIC may only hear appeals from the Industrial Arbitration Panel’s, or IAP’s, rulings on matters related to trade disputes.

ASUU said it was totally “dissatisfied with the decision of the trial court which it said should not only be stayed from being executed, but also set aside in its entirety.”
