Nnamdi Kanu: Appeal Court Withholds Judgement Over FG’s Request

The application hearing was presided over by Justice Haruna Tsanami, who stated that the parties will be notified when the verdict would be delivered.

The Federal Government went the Court of Appeal in Abuja on Monday to request a stay of execution of its decision ordering the release of Nnamdi Kanu, the leader of the Biafra nation movement. The court responded by saying it will announce a new date for ruling.

According to Anaedoonline.ng, Justice Haruna Tsanami, who presided over the application’s hearing, stated that the parties will be informed of the judgment’s delivery date as soon as it was prepared.

The Federal Government argued before the Court of Appeal at the application hearing that Nnamdi Kanu, the leader of the Biafra nation movement, poses a serious threat to national security and must be detained in order to maintain some semblance of peace.

In addition, the government said that Kanu poses a flight risk and would leave the nation if the ruling ordering his release was not suspended.

The Federal Government argued in a motion to suspend the October 13 execution in Kanu’s favor that the Biafra nation agitator would jeopardize national security and harm both public and private economic activity.

When defending the application, the Federal Government’s attorney, Mr. David Kaswe, informed the Appellate Court that Kanu had previously shown himself to be a flight risk when he left the nation after being granted bail for the terrorism charges brought against him before the Federal High Court in Abuja.

Kaswe stated that Kanu should be kept in jail until the outcome of an appeal that has already been filed with the Supreme Court in order to uphold justice and maintain some semblance of peace in the South East and throughout all of Nigeria.

“My Lords, our concerns, the concern of the Federal Government is the threat the release of Kanu poses to the security of this country and its political, social and economic activities. We will not be able to lay hands upon him if he is allowed out of detention and finds his way out of the country”.

In order to allow Kanu to remain in detention awaiting the outcome of the pending appeal, he consequently asked the court to postpone executing the ruling.

But Kanu’s principal attorney, Chief Mike Ozekhome SAN, rejected the notion that the defendant jumped bail during his Federal High Court trial.

Ozekhome alleged that it was only through the grace of God that his client survived the Military’s wrongful invasion of Kanu’s ancestral home.

The senior attorney told the court that the Federal Government had disobeyed the October 13 order and as a result had no moral or legal standing to request something from the same court.

Contrary to the Federal Government claim, Ozekhome said that it is only the release of his client that will ensure peace and tranquility not only in the South East but the entire country.

”My Lord, the action of the Federal Government in respect of Nnamdi Kanu is an insult, a slap in the face to this court. It is also an invitation to anarchy and I humbly urge this Court to dismiss the application for lacking in merit.” he argued.

After hearing the arguments from the parties, Justice Tsanami declared that the judgment had been reserved and that the lawyers will be notified when it was ready.
