Suit Against Stella Oduah’s Candidacy Thrown Out By Court

A Federal High Court in Abuja has dismissed a complaint brought against Senator Stella Oduah trying to invalidate her People’s Democratic Party senatorial nomination for Anambra North Senatorial District, according to Anaedoonline.ng.

The plaintiff’s petition, brought by John Emeka, a PDP senatorial hopeful in the May 27 primary, was rejected by Justice Inyang Ekwo for being status barred.

Emeka had sued Oduah, the PDP, and INEC as the first, second, and third defendants, alleging that Oduah lied under oath in her expression of interest and nomination papers.

The complaint further claimed that Oduah utilized the same facts under oath in prior general elections as the PDP’s candidate for Anambra North Senatorial District in 2015 and 2019.

On October 13, Justice Ekwo scheduled a hearing on the case for today.

Emeka requested the court in the originating summons marked: FHC/ABJ/CS/841/2022, dated and submitted on June 8 by his lawyer, Mbanefo Ikwegbue, to declare that the information supplied by Oduah in her INEC Form CF001 regarding her involvement in the National Youth Service Corps (NYSC) scheme was fraudulent.

He claims that the statute violates Sections 12(1)(a)(b)(c) and 13(1)(a) of the NYSC Act.

He further asked the court to rule that because of the false information she provided on her INEC Form CF 001 on her membership in the NYSC Scheme, she was ineligible to run in the aforementioned elections or any other election into the Nigerian Senate.
