Tribunal: Court Adjourns Atiku’s Petition Against Tinubu Till Friday

The case filed by Peoples Democratic Party (PDP) presidential candidate Atiku Abubakar contesting the results of the February 25 presidential election has been postponed by the Presidential Election case Court (PEPC) in Abuja.

The five-member panel, presided over by Justice Haruna Tsammani, deferred the meeting so that pre-hearing issues could be addressed and the respondents’ pending applications could be heard.

The Independent National Electoral Commission (INEC), President-elect Bola Tinubu, and the All Progressives Congress (APC) are respondents in the case.

Justice Tsammani announced during the adjournment that the court will determine the number of witnesses each party was permitted to call, how much time would be allotted for their presentation, and how long cross-examination would go.

He urged the parties to work together and come to agreements on further frameworks to be adopted.

A number of things are requested in the joint appeal by Atiku and the PDP, designated CA/PEPC/05/2023, including the cancellation of the Certificate of Return given to the President-elect by INEC.

The petitioners contend that the Electoral Act of 2022’s requirements were not followed, making Tinubu’s declaration as the election’s victor illegitimate.

They also contend that Tinubu was not legitimately elected by the majority of valid votes cast and that his candidacy was tainted by unethical tactics.

As the candidate with the second-most legitimate votes, Atiku also asks the court to declare him the election’s victor.

On Friday, the court will pick up where it left off in order to resolve outstanding issues and decide how to proceed with the case.
