On Wednesday, the Court of Appeal in Abuja denied the appeal of the Labour Party’s Presidential candidate, Mr Peter Gregory Obi, to prevent the Independent National Election Commission, INEC, from reconfiguring the BVAS technology used in the February 25 Presidential election.

The Court ruled that granting the plea would imperil the electoral body’s ability to conduct the gubernatorial and State Houses of Assembly elections on March 11.

The Court agreed with INEC that the accreditation information contained in the BVAS devices had been uploaded to its backup system and was available at any moment.

The Appellate Court based its agreement with INEC on the fact that all averments in the Electoral Body’s counter-affidavit were not disputed.

The Court stated that allowing Obi and the Labour Party’s appeal will bind INEC’s hands in conducting the gubernatorial election on Saturday.

The Court also ruled that INEC’s assurances that information on BVAS devices cannot be tampered with during uploading were not challenged by Obi and so declared legitimate.
