Peter Obi Files Fresh Application To Inspect BVAS Used For Presidential Poll

Peter Obi, the Labour Party’s (LP) presidential candidate, has filed a new application to physically verify all of the Bimodal Voter Accreditation System (BVAS) utilized in the presidential election.

On Wednesday, Obi and his party filed a new application at the Court of Appeal in Abuja, marked CA/PEC/09m/23, requesting permission to perform a physical inspection of all BVAS used in the presidential election.

Obi and LP, through their team of lawyers led by Onyechi Ikpeazu, SAN, stated the essence of the application is to enable them to extract data included in the BVAS, “which represent the actual results from Polling Units”.

They specifically applied for; “leave to carry out a digital forensic and physical inspection of BVAS, etc”, as well as to obtain the Certified True Copy, CTC, of all the data in the BVAS.

“My lords, this is to ensure that the evidence is preserved before the BVAS are reconfigured by INEC. This is because if they are wiped out, it will affect the substance of our case.”

Meanwhile, the Independent National Election Commission (INEC) legal staff contested Obi’s plea on BVAS used in the presidential election.

INEC requested the court to dismiss Obi and the LP’s new motion, arguing that granting the request would jeopardize its preparations for the next Governorship and National Assembly elections.

Nevertheless, after hearing from all parties, a three-member appellate court bench led by Justice Joseph Ikyegh delayed all applications until today for a ruling.

Remember that the panel, in a judgement issued last Friday, granted Obi and Atiku access to all sensitive materials used by INEC to conduct the presidential election.

The two contended that the requested records would aid their petition challenging the outcome of the presidential election, which was announced in favor of the APC’s nominee, Tinubu.

Furthermore, Obi and Atiku won a court order providing them leave to file the application outside or before the scheduled pre-hearing session for the substantive petitions.

Tinubu of the APC was proclaimed the victor of the presidential election by INEC, beating out 17 other candidates.

According to INEC, Tinubu received 8,794,726 votes to defeat Atiku, who received 6,984,520 votes, and Obi of the LP, who received 6,101,533 votes.

Both the PDP and the LP have already rejected the election results and pledged to dispute them in court.
