Why Tribunal Should Stop INEC From Reconfiguring BVAS – Peter Obi’s Lawyer

Peter Obi, the presidential candidate of the Labour Party (LP), has petitioned the Presidential Election Tribunal sitting at the Court of Appeal in Abuja to prevent the Independent National Electoral Commission (INEC) from reconfiguring the BVAS.

According to news reports, Peter Obi informed his counsel, Onyechi Ikpeazu, that INEC may tamper with its evidence in the BVAS.

Remember that INEC had asked the Presidential Election Petition Court (PEPC) to change the presidential candidates of the Peoples Democratic Party (PDP) and the Labour Party (LP), Atiku Abubakar and Peter Obi, to review electoral materials for the presidential election.

The commission stated that the Bimodal Voter Accreditation System (BVAS) will need to be reconfigured for the next round of elections.

But, Peter Obi’s lawyer sought an injunction on Tuesday authorizing his counsel to do a digital, forensic, and physical check of the BVAS in order to prove that the just concluded election was rigged.

He claimed that the information in the BVAS is accurate and that he also need a certified true copy of the election results for verification.

Onyechi Ikpeazu requested that his prayers be allowed in order to ensure that the evidence is kept and not tampered with, noting that the information on the INEC backend system can be modified.

But, INEC’s lawyer, T. Inuwa SAN, urged the court to dismiss the plea because allowing it would cause a significant delay in the conduct of the upcoming governorship and House of Assembly elections.

He further stated that no information will be lost as a result of transferring BVAS data to INEC’s backend system.

He said: “There are about 176,000 polling units across the nation and which we need to reconfigure each BVAS devices.

“No information will be lost by reason of transferring BVAS to our backend server”

After hearing their arguments, the court fixed Wednesday for ruling.
