Guber Election: Allow Use Of Temporary Voters Cards – Court Tells INEC

The Federal High Court in Abuja has directed INEC to allow the use of Temporary Voter Cards (TVC) in the March 18 governorship election.

The order was issued by the presiding court, Judge Obiora Egwuatu, on Thursday while delivering judgment in a suit filed by two Nigerians seeking to utilize TVCs in general elections when Permanent Voter Cards (PVCs) are not available.

According to the judge, the order was issued on the assumption that the plaintiffs were properly registered and recorded in INEC’s database prior to the start of the general election.

The court, however, stated that because the suit was not filed in a representative capacity, it would be unable to accept petition three, which was to allow any qualified voter with a TVC to vote.

The judge said, “This suit having not been brought in a representative capacity, I find myself unable to grant any relief pursuant to prayer three of the plaintiff’s application.”

According to the court, there was no provision in the law, both the 1999 Constitution and the Electoral Act, that specified that only PVCs could be used in an election, but the law did provide for voter’s cards under Section 47.
