Court Refuses To Hear Binani’s Ex-Parte Application On Adamawa Guber Crisis

The ex-parte motion filed by Senator Aisha Dahiru Ahmed, commonly known as Binani, the All Progressives Congress’s (APC’s) candidate for governor of Adamawa, in the dispute over the release of the results of the 2023 election, was rejected by the Federal High Court in Abuja on Tuesday.

Her attorney, Mohammed Sheriff, requested the court in an ex-parte application to rule on whether the Independent National Electoral Commission, INEC, can take any further action regarding the proclaimed results of the governorship election made by its Resident Electoral Commissioner, Mr. Hudu Ari.

However, just as the ex-parte request was going to be made, Justice Inyang Edem Ekwo intervened and asked Binani’s attorney if his court had the authority to hear the case.

The Judge then instructed Binani’s attorney to submit his response to the matter and set April 26 for the hearing of the ex-parte application and the motion regarding the legitimacy of the court’s authority.

Another attorney, Afeez Matanmi, who claimed to represent the current governor of Adamawa State, Ahmadu Fintiri, earlier attempted to address the court but was barred on the grounds that the matter was an ex-parte motion for the time being.

The Independent National Electoral Commission, the Peoples Democratic Party, and Ahmadu Fintiri are the defendants in the ex-parte application.
