Gov Adeleke Dragged To Court By APC For Appointing Self, Deputy As Commissioners

The All Progressives Congress (APC) of Osun State has taken Governor Ademola Adeleke to court for installing himself as Commissioner for Works.

APC filed a complaint in the State High Court in Osogbo, challenging Adeleke’s appointment as Commissioner for Sports and Special Needs, as announced by the Osun State administration on July 19, 2023.

The main opposition party, through its lawyer, Sherif Oluyombo, objected to the nominations and asked the court to rule on whether a sitting governor can hold any other administrative office.

The plaintiff asked the court, citing Sections 192(2) and (5) of the Nigerian constitution, whether “a person can be validly appointed a commissioner of the government of a state if his nomination is not forwarded to and received by the State’s House of Assembly for purposes of confirmation.”

According to news sources, Adeleke is not the first public official to undertake multiple duties.

It should be noted that the immediate previous president, Muhammadu Buhari, appointed himself as petroleum minister in 2015, Ibe Kachikwu as minister of state for petroleum, and Timipre Sylva as minister of state for petroleum in his second term, with no opposition from his party members.

The decision of the case may potentially bar President Bola Ahmed Tinubu from serving in a ministerial capacity should the court illegalise elected officials from having double appointments.
