The National Youth Service Corps (NYSC) filed charges of fabrication of a release certificate against Barrister Peter Ndubuisi Mbah, the governor of Enugu State, but the Federal High Court in Abuja dismissed the case on Monday.
After the Corps failed to provide the necessary evidence to support and refute the charges as required by law, Justice Inyang Eden Ekwo dismissed the accusations.
In ruling in the governor’s lawsuit against the NYSC, the judge fined the Corps N5 million, to be paid in part to the plaintiff, for concealing information and working together to discredit him in the vile accusations.
NYSC Tenders Evidence Against Gov Peter Mbah In Court
The plaintiff’s uncontested testimony about how the NYSC granted him a discharge certificate in 2003 after he completed his service at a Lagos law firm, together with the Corps’ inability to produce any counterevidence, led the court to conclude that the plaintiff had completed the required one-year service.
Justice Ekwo found, among other things, that although the NYSC had a major burden of proof to support forgery claims, it was unable to do so, making Mbah’s evidence stronger and more credible.
Mbah filed a lawsuit against the NYSC and Ibrahim Muhammad, the Corps Certification Director, for releasing a statement that refuted the issuance of the discharge certificate that was granted to him on January 6, 2003.
On February 1st, the NYSC sent a letter, signed by Ibrahim Muhammed, stating that the NYSC certificate that Mbah was in possession of was not issued by the Corps.
