Before Bola Tinubu, the president-elect, takes office on May 29, Nnamdi Kanu’s special counsel, Aloy Ejimakor, has brought up a constitutional concern.
According to Ejimakor, it is unlawful to swear in an election winner whose victory has not yet been confirmed by a court.
He emphasized that when the election results were uncontested, the victor may be sworn in.

Ejimakor emphasized in a conversation with Newsmen that no Nigerian law permits the swearing-in of a winner when the election outcome is being challenged in court.
He wrote: “Given that the FINALITY of election result is decided by the Court, except where the INEC-declared result is uncontested, it’s unconstitutional to swear-in a winner whose victory has not been affirmed by the Court.
“Where’s the law that says such a winner must be sworn-in? None!”
