A Federal High Court in Abuja, on Thursday, cited a fresh Court of Appeal ruling on defection.
Ben Ayade’s gubernatorial seat was declared empty when he defected from the Peoples Democratic Party, PDP, to the All Progressives Congress, APC.
Justice Taiwo Taiwo deviated from his previous ruling and upheld the Court of Appeal’s finding of April 1 that defection of a Governor and his Deputy is not a crime under the Nigerian Constitution for the time being.
Silence As Court Puts Ayade’s Defection Judgment On Hold
The Judge ruled that governors and their deputies can only be removed from office in accordance with the Constitution’s sections 180, 188, and 189, which provide that they can only be removed from office due to death, resignation, or impeachment.
Because defection is not a constitutional clause, no court has the authority to add it to the Supreme Law, according to Justice Taiwo.
He did agree, however, that defecting from a winning to a losing party is unethical and unprofessional.
