In a lawsuit disputing the results of the 2023 presidential election, five INEC ad hoc staff employees are scheduled to testify as witnesses.
Atiku Abubakar, a former vice president and candidate for the Peoples Democratic Party (PDP), filed the petition, alleging that President Bola Tinubu of the ruling All Progressives Congress (APC) was given an unfair advantage during the election.
Atiku charges the INEC with using third-party devices to rig the election in favor of the APC and Bola Tinubu, the party’s candidate, in a 66-page appeal.

He added that Suleiman Farouk, an IT consultant, replaced Chidi Nwafor, the INEC’s in-house ICT specialist, ahead of the election, and helped install the purported third-party mechanism.
According to Atiku, Farouk oversaw a Device Management System (DMS) that tampered with data from the IRev Portal and the Bimodal Voter Accreditation System (BVAS).
He said that by this system, INEC rigged the election results in Tinubu’s favor.
He asserted, “The 1st Respondent used the said Device Management System to manipulate the Election results in favour of the 2nd and 3rd Respondents.”
Chief Chris Uche, the petitioners’ attorney, announced in court on Wednesday that his clients had called five INEC ad hoc staff members who were involved in the election to testify.

Abubakar Mahmood, the main attorney for INEC, objected when the first witness entered the stand.
Mahmood said that he needed more time to examine the witness testimonies because he only got them just before the hearing started.
Additionally, he said that he needed time to check with the INEC to confirm the witnesses’ identification. This position was shared by the attorneys for Tinubu and the APC.
The five-member panel, led by Justice Haruna Tsammani, initially suggested a brief recess, but eventually opted to postpone further proceedings till Thursday to offer time for INEC’s counsel to complete his investigation.
Certified copies of the presidential election results from 10 Kogi State Local Government Areas were presented earlier in the proceedings.

Ndubuisi Nwobu, the chairman of the PDP in the Anambra state, testified that he visited roughly 30 polling places but that none of them had real-time election results published to INEC’s I-Rev platform.
Atiku is asking the court to reject President Tinubu’s Certificate of Return in favor of declaring him the legitimate winner of the presidential election.
