Wike Blasts Shehu Sani, Ozekhome Over Democracy Sentence

Nyesom Wike, the minister of the Federal Capital Territory (FCT), has criticised Shehu Sani and Mike Ozekhome, SAN, a prominent Nigerian attorney, for their views on the current government.

At the Nigeria Annual Lecture and Gold Prize Award, 2024, held in Abuja to commemorate Nigeria’s 25 years of continuous democracy, Wike, Ozekhome, and Sani were gathered with dignitaries.

This year’s guest lecturer, Chief Ozekhome, infuriated the FCT Minister by reading his speech word for word without addressing the areas in which the nation had achieved some development over the previous 25 years.

Furthermore, it was not well received by Wike when Shehu Sani, a former federal senator, urged President Bola Tinubu to take action to end hunger in Nigeria.

Wike questioned the decency of the two activists for making such calls.

He asked Ozekhome if he had ever turned down briefs, even as he insisted on knowing what Sani had accomplished during his lengthy tenure as a senator.

He informed Ozekhome that the senior attorney has never turned down an assignment, not even one involving defending individuals who have rigged elections in court.

“So I said that I’ll put this to you and to tell my brother friend, for the main fact that you people were activists does not mean that you’ll do well, no.

“Activists have always failed. We’ve seen activists that were given appointments and yet they failed. When you were in the Senate, how did you perform? What was our performance as Senator?

“And you’re saying something about rigging elections and … as an activist, how many times have you rejected briefs? Those who have rigged elections, you have even defended them.

“So, it is about everytime we come here and postulate, postulate and postulate.”

He added, “First of all we’re talking about 25 years of democracy. I know we have challenges but I expected the lecturer to say, ‘yes, we’ve made some progress.’

“In all this lecture, not one progress was made . [It was about] criticism after criticism. Are you telling me that in 25 years, not one progress was made .

“Yes, you can say we’ve made this progress but still the need for us to move forward. Just like Shehu Sani said how they were detained, he didn’t say that under this democracy no Nigerian has found himself under this aspect, that’s progress.

“You’ve said here about infrastructure in FCT, who’s FCT minister working under? Mr President. That means he has the capacity to know those who can help him move the country.”

Ozekhome Requests Analysis Of Presidential Election Judgement From Supreme Court Judges

Mike Ozekhome (SAN), a prominent attorney and advisor to former vice president Atiku Abubakar, the Peoples Democratic Party’s (PDP) presidential candidate, has expressed concerns on the unbalanced selection of Supreme Court justices.

He specifically brought up the recent appeal against President Bola Ahmed Tinubu in the presidential election involving Atiku Abubakar and Peter Obi.

According to Ozekhome, Nigeria’s constitution calls for 21 jurists to guarantee equitable representation. He noted that there are only 10 justices at the moment because the Chief Justice of Nigeria (CJN) does not hold a full administrative officer position.

Ozekhome reportedly questioned the Supreme Court’s capacity to carry out its mandate with such a small membership and demanded a more thorough examination of the court’s decision on the case, as it carries significant policy implications.

He also expressed disapproval of the 2022 Electoral Act’s disdain for technical developments, which he feels have been compromised by the court’s ruling.

Remember that Chief Justice of Nigeria (CJN), Justice Olukayode Ariwoola, was accused of abusing his position by retiring Supreme Court justice Musa Dattijo Muhammad, who reportedly withdrew from the seven-member panel that rejected all appeals seeking President Bola Tinubu’s removal from office.

Speaking at a farewell event hosted in his honour by the Supreme Court, the retired judge exposed the flaws in the legal system that still impact the nation’s legal system.

On the panel that heard the presidential election appeals by Atiku Abubakar and the Labour Party (LP) presidential candidate, Peter Obi, Justice Muhammad, said: “To ensure justice and transparency in presidential appeals from the lower court, all geo-political zones are required to participate in the hearing.

“It is, therefore, dangerous for democracy and equity for two entire regions to be left out in the decisions that will affect the generality of Nigerians.

“This is not what our laws envisage. Although it can be posited that no one expected the sudden passing of Hon. Justice Nweze JSC, yet, it has been two years and seven months since the previous justice from South-East died, and no appointment was made.”

Mazi Nnamdi Kanu, the jailed leader of the Indigenous People of Biafra, IPOB, has increased his demand for the cessation of repeated sit-at-home operations in the country’s south-eastern region.

In a video obtained by Newsmen, Kanu talked through one of his lawyers, Mike Ozekhome, SAN.

On Monday, Dan Nwomeh, the Senior Special Assistant, Mainstream Media to Enugu State Governor Peter Mbah, tweeted the video on his Twitter account.

Kanu, according to Ozekhome, does not believe in the sit-in, claiming that he cannot fight for his people while shutting down their economy.

He bemoaned the impact of the sit-at-home exercise on people’s social, economic, cultural, and political life of the people, lamenting that it has put them under psychological, psychical and mental stricture.

”As his lead counsel and lawyer, he has told me that he does not believe in it (Sit-at-home); he can not be fighting for his people and shutting down their economy. How do they feed? How will they train their children? Many a time, he cried to me in my presence that he wants to be released so that he can hold a world press conference and address the Igbo and Ala Igbo and the entire world to say, ”Don’t stay at home on Mondays, go about your normal duties, go to work; because the Bible tells us it is upon the labour of your hands, I will bless the fruits of your labour.

”So, I am now re-echoing again and again what Nnamdi Kanu has told me, ”He does not believe in that sit-at-home on Mondays,” which cripples the social-economic, social-cultural and political life of the people, putting them under psychological, psychical and mental stricture and torture,” Kanu said through Ozekhome.

Reports that Mike Ozekhome was fired as the principal attorney for Mazi Nnamdi Kanu, the embattled leader of the Indigenous People of Biafra (IPOB), have been denied by his lawyer, Ifeanyi Ejiofor.

According to news sources, Kanu’s younger brother, Kingsley Kanu, also known as Kanunta Kanu, announced earlier that Ozekhome, a Senior Advocate of Nigeria (SAN), is no longer the head of the IPOB leader’s legal team who is currently in the custody of the Department of State Services (DSS).

Kanunta Kanu, in a message on his Twitter page, accused Ozekhome of, among other things, refusing to allow Kanu’s personal physicians access to him for urgent ear surgery, which was one of the reasons for his dismissal.

Kanu’s lawyer, Ejiofor, responded quickly, calling Kanunta’s remarks “defamatory, mischievous, fake, reprehensible, denigrating, insulting, and unauthorized.”

According to him, the IPOB leader’s brother was being devious, and his social media post was intended to mock and disgrace Kanu’s legal team.

“In view of the desperate attempt of the enemies to break our rank, the legal team resolved to minimise the information that we make public through my regular updates. Therefore, you will not be receiving updates on our routine visits as regularly as it used to come, except when there is a compelling situation that demands it. Several visits to Onyendu, and particularly, the visit of June 3, 2023, was not publicised because of the nature of the matters discussed, but the relevant persons were duly briefed on the outcomes,” Ejiofor noted.

According to newsmen, Ejiofor made these remarks in a statement made available to journalists on Thursday evening after visiting Kanu at the DSS headquarters in Abuja.

The full statement reads: “Let it be on record that Neither Kingsley Kanu nor Emmanuel Kanu, had at any point in time briefed me to handle Onyendu Mazi Nnamdi Kanu’s case or even IPOB’s matters. My letters of engagement issued to me in 2015 by Onyendu Mazi Nnamdi Kanu and IPOB are still with me till date.

“Neither Kingsley Kanu nor anybody acting on his behalf engaged Mike Ozekhome, to represent Onyendu in any matters affecting him. During that meeting, which details are already in the public domain, Onyendu personally briefed Mike Ozekhome to head his legal team. Till date, Mike Ozekhome, SAN has done creditably and overwhelmingly well in deploying his advocacy skills in representing Onyendu in all Courts in Nigeria.

“Further to the above, my briefings with Onyendu lasted for over one hour, during which we discussed pertinent issues concerning his legal and health matters. There was no time during the meeting that Onyendu entertained or expressed any iota of doubt whatsoever on the ability of his indefatigable legal team, ably led by Mike Ozekhome, to defend him. Onyendu also proceeded to avail me with other important messages to be passed on to his lead counsel which assignments are expected to be conducted within the next 24 hours.

“Kingsley Kanu in a bid to preempt any exposition I may make after today’s visit proceeded to make the ridiculous publication at exactly 1:57 pm Nigerian time, a few minutes before the scheduled visit of 2:00 pm. He need not have worried because out of respect and deference to Onyendu Mazi Nnamdi Kanu, I do not intend to make any such exposition.

“As you may be aware, right from July 26, 2021, when an order was made by Hon. Justice Binta Nyako, directing the DSS to allow Onyendu access to his lawyers and relatives, upon prior submission of the names of those visiting Onyendu, my chambers has been exclusively submitting names of those visiting Onyendu and this process still subsists. The names are usually shared with Onyendu before clearance is given by the DSS for the visits to take place.

“Against the backdrop of the foregoing, I wish to unequivocally state that Onyendu Mazi Nnamdi Kanu never dismissed, disengaged, neither has he expressed any intention of dismissing his legal team ably led by Prof. Mike Ozekhome. Biafrans and indeed the members of the general public are respectively advised to ignore in its entirety, the obviously defamatory, mischievous, fake, reprehensible, denigrating, insulting and unauthorized public notice issued by Kingsley Kanu alias Kanunta Kanu, as it is not true.”

Ejiofor informed the general public and Biafrans on Kanunta’s plot for dishing out such condemnable falsehood. He insisted that the IPOB leader’s brother only wanted to ridicule and embarrass Kanu’s legal team ably led by Ozekhome.

He added: “Kingsley Kanu should be assured that his evil strategies are dead on arrival. There is nothing whatsoever, that will stop or deter Onyendu’s legal team who are tirelessly working day and night to ensure that Onyendu is released unconditionally.

“In conclusion, Onyendu further used the opportunity offered by my visit to thank Ezigbo Umuchineke for standing shoulder to shoulder with him, particularly all through this trying time. Onyendu assured Ezigbo Umuchineke once again that it shall surely end in Praises. He urges you all to remain firm, steadfast, and unrelenting in your supplications to God.

“Furthermore, Onyendu implores Ezigbo Umuchineke to continue to abide by your peaceful conduct as you have consistently demonstrated.”

Ejiofor also clarified that the medical doctors who attempted to see Kanu last week Tuesday, June 6, 2023, were not there to participate in any surgical procedure but to first meet and interface with him.

He said the doctors were expected to consult with Kanu’s lead counsel- Mike Ozekhome, before proceeding with other administrative engagements as they agreed during their meeting on June 3, 2023, held with the DSS in the presence of the IPOB leader.

The family of Mazi Nnamdi Kanu, the jailed leader of the Indigenous People of Biafra (IPOB), has announced the termination of the appointment of the pro-Biafra agitator’s primary Counsel, Mike Ozekhome (SAN) and Ifeanyi Ejiofor.

According to Newsmen, Kanu’s younger brother, Kanunta Kanu, released a message on Thursday that was shared on his Twitter profile.

The statement entitled ” Notice of Dismissal”, read: “I hereby formally notify @MikeozekhomeSAN and @lfeanyiEjiofor that their services are no longer required in #MaziNnamdiKanu case pending before the Supreme court of Nigeria and all concerning him.”

Nnamdi Kanu’s Family Still Denied Access To IPOB Leader – IPOB Lawyer

Ozekhome’s reported unwillingness to allow Kanu’s personal physicians access to him for urgent ear surgery was one of the grounds for his dismissal, according to Nnamdi Kanu’s brother.

He wrote: “After Mazi Nnamdi kanu’s case on 11th May 2023 Prof Mike Ozekhome SAN has refused to see his client in DSS headquarters Abuja even after several messages from #MNK to see him.

“Secondly, for stopping the medical doctors who were to examine #MNK on 5th June even when he and Bar. lfeanyi Ejiofor were duly informed on 2nd of June and #MNK told them to inform his family to arrange that. For this obvious reasons and many more, Prof Mike Ozekhome SAN and Barr. Ifeanyi Ejiofor are hereby SACKED as Mazi Nnamdi Kanu’s counsels.

“The Kanu’s family do appreciate your time and efforts so far, please handover the legal documents asap.”

Mike Ozekhome, the senior attorney for Nnamdi Kanu, the head of the Indigenous People of Biafra (IPOB), has expressed his concerns to the Supreme Court that his client could pass away while in the care of the Department of State Services (DSS).

Ozekhome was speaking on Thursday during the hearing of Kanu’s case.

He told the apex court that the IPOB leader is very sick and requires surgery.

The lawyer prayed the court to rule in favour of Kanu’s transfer from DSS custody to Kuje correctional centre, to enable him begin treatment.

“My Lords, Nnamdi Kanu is sick, he has been approved for surgery but they have refused to release him for treatment.

“He’s getting really sick, I’m scared he may die in the custody of DSS. Dead bodies are not prosecuted,” BBC News Pidgin quoted Ozekhome as saying.

Reacting to Ozekhome’s plea, the Supreme Court said God will keep Kanu alive and that he will not die in detention.

Mike Ozekhome, a Senior Advocate of Nigeria (SAN), has responded to the announcement that Aisha Dahiru Binani, a candidate for the All Progressives Congress (APC), has won the governorship election in Adamawa State.

News outlets reported that Binani had been named the victor of the governorship race on Sunday by the state’s Resident Electoral Commission (REC), Hudu Yunusa-Ari.

While the Saturday supplementary election’s results were still being tallied and Yunusa was acting in place of the state returning officer, Professor Mohammed Mele, he made this announcement.

However, the Independent National Electoral Commission (INEC) rejected Yunusa’s announcement, halted the results’ tabulation, and called the REC to Abuja.

Ozekhome referred to Senator Binani’s declaration as an abomination that shouldn’t be tolerated in an interview with the Punch on Sunday.

According to the Electoral Act, the only person with the authority to proclaim the winner of an election, according to the human rights activist, is the INEC returning officer.

The errant REC might be sentenced to 36 months in prison, according to Ozekhome.

“It is even more absurd that the Adamawa State REC did not only usurp the powers of the Returning Officer but attempted to declare a winner without figures in reckless violation of the provisions of the Constitution of the Federal Republic of Nigeria 1999 (as amended), the Electoral Act, 2022, the Independent National Electoral Commission Guidelines as well as the sensibility of the people of Adamawa State, ” he said.

Mike Ozekhome (SAN), a human rights lawyer, has denounced President Muhammadu Buhari for allegedly defying a Supreme Court decision.

According to news reports, the Supreme Court has ruled both the old and new naira notes be used concurrently until it rules on a matter brought before it by Kaduna, Kogi, Zamfara, and other states.

Nevertheless, in a nationwide broadcast, President Buhari defied the Supreme Court’s interim decision directing the Central Bank of Nigeria to only disburse the old 200 naira notes.

In a statement issued on Friday, Ozekhome, who believed the president was wrong to ignore the order, termed it as a ‘dicta, more in the form of a military Edict’.

He said, “Buhari, in his broadcast on Thursday, February 16, 2023, unilaterally varied the apex court’s extant order of maintenance of status quo, by directing the CBN Governor to the effect that ‘the old N200 banknotes be released back into circulation…to circulate as legal tender with the new N200, N500 and N1000 bank notes for 60 days…’

“The President then issued a dicta, more in the form of a military Decree, that, ‘in line with section 20 (3) of the CBN Act, 2007, all existing old N1000 and N500 notes remain redeemable at the CBN and designated prints’.

“This order is a clear violation of and disobedience to the existing order of the apex court which had already maintained the status quo ante bellum of all parties involved in the Naira re-design dispute.

“The Supreme Court had on Wednesday, February 15, 2023, after the first interim order, adjourned the suit originally filed by the Attorneys-General of Kano, Kogi and Zamfara states (other interested parties were later joined) to February 22, to enable it hear the entire matter holistically.”

Buhari, according to Ozekhome, has demonstrated the characteristics of an Emperor and Overlord via his disobedience.

He said, “Every Nigerian had expected that the Federal Government would respect this apex court’s position. But President Buhari demurred. He made himself Supreme Leader; an Emperor; Potentate, Mikado and Overlord.”

He claimed that Buhari’s address to the country effectively overruled the Supreme Court of the Nation in a way that only a military despot could consider.

The lawyer added that, “Buhari’s action is a reminder of the apocryphal saying of autocratic and despotic Emperor Louis XIV, who, on 13th April, 1655, stood in front of Parliament and imperiously declared, ‘L’Etat C’est Moi (I am the State)”. This was to underline the fact that he and he alone, had absolute power over his Nation.’”

Ozekhome said Buhari’s decision might lead to turmoil, anarchy, and national instability, and that it was a direct challenge to the Supreme Court’s authority.

According to him, the order is also an assaukt on the “head of the entire Judiciary, the 3rd arm of government under the idea of separation of powers, most ably promoted in 1748 by Baron de Montesque, a renowned French Philosopher.

“To have whimsically and capriciously varied the order of the Supreme Court was to pick and choose what order to obey or disobey. This breaches the supremacy of the 1999 Constitution provided for in section 1(1) thereof. It also frontally assaults the provisions of section 287(1) of the Constitution which provides that ‘the decisions of the Supreme Court shall be enforced in any part of the Federation by all authorities and persons, and by courts with subordinate jurisdiction to that of the Supreme Court.’”

He advised the Supreme Court not to allow this slide, since the President in his speech alluded that the matter was before the apex court.

Ozekhome said, “This is one instance where the apex court should bare its teeth and bite. This is more so because President Buhari had himself acknowledged in his speech, the pendency of the matter before the Supreme Court. Surely, no one is above the law; not even President Buhari himself.”

Nnamdi Kanu Is Critically Sick, Needs Surgery – Mike Ozekhome

According to report, Mazi Nnamdi Kanu’s primary attorney, Chief Mike Ozekhome (SAN), has stated that Kanu may require “urgent heart surgery” due to a deficiency of potassium in his circulation.

This happened as he and his group of over 18 attorneys signed Order 34, a notice of application for an Order of Judicial Review, in the Abuja Judicial Division of the Federal High Court in Abuja.

A court order dated December 20, 2022, known as suit no. FHC/ABJ/CS/2341/2022, sought to compel the State Security Service to allow Kanu “unrestricted access” to his doctors so they could conduct a “independent examination of his current deteriorating health condition,” as the Federal High Court had previously directed on October 21, 2021.

Kanu’s medical records from June 29, 2021, to the present, including but not limited to admission records, medical and clinical records, nursing notes, observation charts and documentation during treatment or stay in the hospital, laboratory test results, pharmaceutical records, radiological scan, images and reports, blood transfusion records, and records of his physiotherapy and rehabilitative treatment, were also requested by Ozekhome in his request to the court for permission to give Kanu this right.

In addition, the letter detailed Kanu’s “abduction” from Kenya and how he was “subjected to different forms of severe torture and inhuman abuse and degradation, all of which deteriorated his health condition.”

The main attorney also mentioned that Kanu had a slight cardiac attack before to being “smuggled” back into Nigeria and that his health has subsequently deteriorated worse.

“That various medical personnel that attended to the Applicant whilst in custody had repeatedly informed him that they could not ascertain the reason for the depletion of potassium in the applicant’s blood.

“That on various occasions, the medical personnel brought by the respondents took the applicant’s blood sample and allegedly transported same to South Africa for screening; and up till the present, there is no end in sight for their trial-and-error medicare.”

In Abuja, the Independent National Electoral Commission (INEC) has been sued by human rights attorneys Mike Ozekhome (SAN) and Abubakar Sani.

According to Anaedoonline.ng, INEC was sued over its choice to halt the Continuous Voter’s Registration (CVR).

Ozekhome and Sani urged the court in the lawsuit with the file number FHC/ABJ/CS/1335/2022 to order the electoral authority to prolong the continuous voter registration until November 27, which is the deadline for registering voters before the 2023 general election.

Millions of eligible and potential voters would lose their right to vote if the CVR was suspended on July 31, 2022, more than six months before the general elections, according to the duo.

The plaintiffs argued that INEC’s actions were in direct violation of sections 9(6), 10(1), and 12(1) of the Electoral Act 2022, which mandates a 90-day window before the next election before the exercise is stopped.

According to Anaedoonline.ng, Ozekhome and Sani asked the court to decide on five questions.

These include: “Whether having regard to the combined provisions of sections 9(6) and 10(1) of the Electoral Act, 2022, which mandates the defendant (INEC), to continue registration of voters up to 90 days to the date of the election, the defendant can stop or terminate the registration of eligible voters on July 31, 2022, which is more than six months to the next general election scheduled to commence of February 25, 2023?

“Whether having regard to the combined provisions of sections 77(2) and 78 of the 1999 Constitution, section 12(1) of the Electoral Act, 2022, and Article 13(1) of the African Charter on Human and Peoples Rights, the defendant can refuse or decline to register a citizen of Nigeria who has attained the age of 18 years and presented himself to the defendant for registration before 90 days to the scheduled 2023 general elections?”

Although a hearing date has not been set, the lawsuit is backed by an affidavit of urgency in which the defendant stated that they made many unsuccessful attempts to register themselves as eligible voters for the 2023 election.
