The Supreme Court of Nigeria has verified and certified Chief Edozie Njoku as the National Chairman of the All Progressive Grand Alliance (APGA), despite a long-running debate over the party’s leadership.
This was stated in a letter written on behalf of the Chief Justice of Nigeria by the Chief Registrar of the Supreme Court of Nigeria, Hajo S A I Bello, Esq., on January 19, 2023, with reference number SC/CV/687/20221.
Addressing Chief Edozie Njoku as APGA’s National Chairman, Bello advised him on the legal steps to gain legal recognition and assume full leadership of the party, in a letter titled “Request for the authentication and confirmation of the Supreme Court judgement in suit no. SC/CV/687/2021 between Chief Jude Okeke & All Progressives Grand Alliance (APGA) ors.”

He advised Njoku to file an application with the Supreme Court under Order 8, Rule 16, of the Rules of Procedure, seeking to correct an error in “the judgment (in which the name of Chief Victor Oye was erroneously mentioned instead of Chief Edozie Njoku), the actual suspended Chairman of the All Progressives Grand Alliance (APGA)” [emphasis ours].
As a result, Bello advised Njoku to file the requisite application for the necessary action as soon as possible.
He wrote: “I am directed by the Honourable, the Chief Justice of Nigeria to acknowledge the receipt of your letter dated 7th day of October, 2022, wherein by way of a letter to the Honourable Justice Mary Peter Odili, JSC Rtd, you requested for a correction of a slip at page 13, lines 3-4, of the judgment (in which the name of Chief Victor Oye was erroneously mentioned instead of Chief Edozie Njoku), the actual suspended Chairman of the All Progressives Grand Alliance (APGA).
“What you ought to have done is to bring an application pursuant to Order 8 Rule 16 of the Rules of this Court seeking to correct the accidental slip in the judgment.

“Consequent upon the foregoing, you are hereby advised to file the necessary application for same as provided in the Court’s Rules as follows:
“The Court shall not review any judgment once given and delivered by it save to correct any clerical mistake or some error arising from any accidental slip or omission, or to vary the judgment or order so as to give effect to its meaning or intention.
“A judgment or order shall not be varied when it correctly represents what the Court decided nor shall the operative and substantive part of it be varied and a different form substituted”.
“Please accept the assurances of the Honourable, the Chief Justice’s warm regard.”
