Court Stops Oye From Parading As APGA National Chairman As Crisis Deepens

Chief Victor Oye has been barred from posing as the national chairman of the All Progressives Grand Alliance (APGA) by Mohammed Madugu, a judge of the High Court of the Federal Capital Territory (FCT), sitting in Bwari.

According to news reports, the judge also prohibited Oye from organizing any conferences, conventions, NEC meetings, or other events under the auspices of the APGA while a lawsuit relating to the party’s leadership issue is being adjudicated.

The order was made in response to a motion on notice filed by Kamaru Ogidan, national vice chairman of the APGA’s South West Geopolitical Zone, and Alhaji Rabiu Mustapha, national welfare officer of the APGA, against Victor Oye and the Independent National Electoral Commission (INEC) under the leadership of Edozie Njoku.

Based on the Supreme Court decision from March 24, 2023, the court also issued an order preventing INEC from recognizing Victor Oye as the national chairman of the APGA.

The judge warned parties not to engage in behavior that would overstep the bounds of the court and directed them to maintain the status quo ante bellum until the outcome of the original summons.

Michael Ajara, the plaintiffs’ attorney, addressed the court on Wednesday and requested that the court consider his move on notice, which he claimed was ready for hearing.

He recalled that on May 3, 2023, the court had rejected the plaintiffs’ ex parte application and had instead instructed the applicants to notify the respondents.

However, the respondent’s attorney claimed that on May 9, he had submitted a memorandum of conditional presence and preliminary objection.

The attorney for the respondents contended that the option on notice was not ready, and instead he urged the court to hear the original summons, to which he claimed to have responded.

Ajara, however, informed the court that the defense attorney’s argument was false and deceptive.

As a result, Ajara pleaded with the court to ignore the defense attorney’s arguments while recognizing that the preliminary objection was not ready for consideration.

The court continued to rule on the submissions of counsel in the face of the argument made by the two attorneys who were representing the parties in the case.

Justice Madugu pointed out that although the respondents filed a preliminary objection, the plaintiff had been directed by the court to notify the respondents.

UPDATE: Court Affirms Victor Oye As ‘Aunthentic’ APGA National Chairman

The case was postponed by the judge until May 17 so that the preliminary objection could be heard.
