The Enugu State Governorship Election Petitions Tribunal has given state governor and Peoples Democratic Party (PDP) candidate in the March 18, 2023 governorship election, Peter Mbah, until June 22, 2023, to respond to interlocutory applications filed by Labour Party (LP) candidate, Chijioke Edeoga.

Remember that Edeoga had gone to the tribunal to challenge the Independent National Electoral Commission’s (INEC) proclamation of Mbah as the winner of the governorship race.

Edeoga has asked the court to disqualify Mbah for alleged certificate fabrication, which he alleges breaches Section 182 (j) of the Federal Republic of Nigeria’s 1999 Constitution.

Mbah’s situation was brought to light in February 2023 when a letter from the National Youth Service Corps (NYSC) challenged a discharge certificate he filed to the INEC as part of his election prequalification.

However, the Labour Party and its candidate, Edeoga, are appealing Mbah’s election victory on a number of grounds, one of which being the issue of certificate fraud.

Whereas lawyers for the PDP and Mbah argued that the NYSC discharge certificate was not a requirement for the election, the Labour Party and its candidate asserted that the matter was a breach of the Nigerian constitution.

As a result, the Labour Party asked the Tribunal interlocutory questions, asking Mbah to clarify where he received his secondary education, as well as the date and year he completed the six-year post-primary education.

Plaintiffs also want Mbah to bring before the Tribunal the year he was admitted to university, the year he graduated, the year he attended Nigerian Law School, and the year he was called to the Nigerian Bar.

The interlocutory application further requested that Mbah furnish information on the year and date he was mobilized for his NYSC program, as well as the date he was discharged.

They also want Mbah to give them the year and date he was appointed Chief of Staff to former Governor Chimaroke Nnamani, as well as the date and time he was appointed Commissioner of Finance by the same governor.
