Tribunal: Tinubu, APC Lose As Court Upholds APM’s Petition On 2023 Presidential Election

The Presidential Election Petition Court (PEPC) rejected an attempt by President Bola Ahmed Tinubu and the All Progressives Congress (APC) to halt the Allied Peoples Movement (APM) in its petition contesting his fitness for the February 25, 2023, presidential election.

Tinubu attempted to utilize a Supreme Court judgment delivered on May 26, 2023, to terminate the APM’s suit through his main attorney, Chief Wole Olanipekun SAN, but the request was denied.

Tinubu’s complaint was that the Apex Court had settled the only issue raised in the APM petition in a ruling in a suit filed by the Peoples Democratic Party (PDP).

He attempted to persuade the Court to invoke the spirit and letters of the Supreme Court judgment to halt the hearing into the APM’s petition.

The Court’s Presiding Justice, Justice Haruna Simon Tsammani, disagreed with Tinubu and ruled that the party could not be barred from participating in a fair hearing.

Tinubu was urged by Justice Tsammani to postpone his objections to the petition’s hearing until the final address stage of the court’s procedures.

Similar objections to the petition submitted by APC through its counsel, Charles Edosomwen SAN, were rejected by PEPC for the same reason.

Previously, the APM had informed the Court of receipt of the Supreme Court judgment sought to be utilized to discontinue its suit through its lawyer, Mr Gideon Ijiagbonya.

The lawyer stated that after reviewing the Supreme Court’s decision, he and his legal team concluded that there is life in the petition and applied for its hearing.

He did, however, request an adjournment until June 26 in order to get a critical document from the Independent National Electoral Commission (INEC) in order to establish his case.

In a quick order, Justice Tsammani rejected a week-long adjournment and set the petition hearing for Wednesday, June 21.
