Court Dismisses Suit Seeking To Reinstate Ayu As PDP National Chairman

A Benue State High Court in Gboko, presided over by Justice D.M. Igyuse, has dismissed a lawsuit that sought to overturn Iyorchia Ayu’s suspension as a PDP member and reinstate him as the opposition party’s national chairman.

On behalf of the 17 executives from Dr. Ayu’s Igyorov Council Ward in the state’s Gboko Local Government Area, one Nongo Ordue filed the lawsuit.

In his response to the lawsuit, Clement Mue, the PDP’s legal representative, said that the Makurdi High Court’s judgement in Utaan versus Ayu, with the case number MHC/85/2023, had adequately addressed the problems made in the plaintiffs’ claim.

Mue claimed the lawsuit was therefore caught up by a bar known in legal parlance as ‘estoppel.’

He informed the court that “Senator Ayu had since filed an appeal at the Court of Appeal against the decision of the court.”

He argued that “hearing and determining the suit would amount to sitting on an appeal against the earlier decision of a court of coordinate jurisdiction.”

The PDP attorney requested that the court rule that the current lawsuit constituted “an abuse of court process.”

In his ruling, Justice Igyuse noted that the plaintiffs had filed a comparable claim in suit No. GHC/36/2023 between themselves as plaintiffs, including Ayu who was the 18th plaintiff, and the said suit had been dismissed on June 27, 2023 by High Court 3, Gboko, on the application of J.T. Injua, who informed the court that the said claim had been filed by the current plaintiffs’ attorney, Nongo Ordue.

The lawsuit was dismissed as a result of Justice Igyuse’s agreement with Mue’s argument, calling it “the worst form of abuse of the court process.”
