Court Grants Enugu APC Leader Restraining Order Against Arrest

The Enugu State High Court has granted an order of interim injunction to the State Chairman of the All Progressives Congress, APC, Bar Ben Nwoye against arrest and unlawful violation of human rights by the Nigerian Police force.

Addressing newsmen at the APC party secretariat, Monday, Nwoye alleged that the Minister of Foreign Affairs, Geoffery Onyema had enlisted the services of the police to ensure that he, alongside the state legal adviser of the party, Bar Ben Nebe and the state administrative Secretary, Evaristus Asadu were arrested and detained.

He explained that the Minister has continued to hunt him and the other party chieftains because of their outright condemnation of the illegal arrest of the Youth Leader of the APC in Enugu West Senatorial Zone, Nwanjoku Okugo.

Recall that operatives of the Inspector General of Police Intelligence Unit had arrested Okugo after he was accused by Onyema of publishing a false information against him( Onyema) and his personnel assistant, Flavour Eze on social media to the effect that they were both infested with the deadly Coronavirus.

Reacting to the arrest which he described as an act of kidnap, Nwoye regretted that Onyema was using his office as minister to harass and oppress those he feels are his political enemies in the state. He said the youth leader was arrested without a warrant.

The lawsuit which was filed before his lordship Hon. Just K.I Okpe Judge on friday, the 24th of April “granted an order of interim injunction to the applicant restraining the respondent whether by themselves their agents, men officers or privies from arresting, detaining or in any manner restricting the applicant’s rights to personal liberty and freedom of movement pending the hearing and determination of the substantive motion on notice”.

Nwoye noted that without the court order, Onyema would further procure the services of the police who would expose them to further threats, adding that the order has also restrained both Onyema, the IG of Police and the commander of the IG’s special squad from interfering with his personal freedom and that of Nebe and Asadu.

“He has continued to threaten our personal liberty and so we had to approach the court where we filed the case on the 22nd of April and after looking through the affidavit, the court ascertained that it was a matter of urgency and had to issue a temporary restraining order against the minister and his Personal Assistant” he explained.

Speaking further, he said ” I have received several calls by the police asking me to come to Abuja in respect to the case”. My life is threatened but i am glad we have the court which is the last hope of the common man.
