The Peoples Democratic Party (PDP) and its presidential candidate, Atiku Abubakar, have been sued, and a Federal High Court in Abuja has set September 14 as the date for the case to be heard.
After approving a request on notice for an extension of time submitted by Atiku, Aminu Tambuwal, the governor of Sokoto, and Priscila Eje on behalf of the PDP, Justice Ahmed Mohammed set the date.
Wilfred Okoi, an attorney for the plaintiffs, did not object to the request, therefore it was granted.

According to Anaedoonline.ng, the lawsuit was filed on June 3 by Michael Ekamon and Governor Nyesom Wike of Rivers State to contest the party’s most recent presidential primary election.
Wike was listed as one of the plaintiffs in the lawsuit with the file number FHC/ABJ/CS/782/2022, although the governor later denied being the one who filed it.
The Independents National Electoral Commission (INEC), Tambuwal, and Atiku are the suit’s second through fourth defendants after the PDP, which is named as the first defendant.
Okoi informed the court that PDP, Tambuwal, and Atiku had served him with a counter affidavit.
Wike asked the court to declare him the PDP’s presidential candidate for the 2023 election among other things in the lawsuit.

Atiku, the PDP, and Tambuwal objected to the lawsuit through their attorney, Kunle Ajibade (SAN), who also called it frivolous, illegal, and unrecognizably a pre-election business.
The first plaintiff, according to the defendants, did not vote in the primary and therefore lacked the necessary locus standi to bring the lawsuit.
According to PDP Atiku and Tambuwal, the lawsuit filed by the applicants does not qualify as a pre-election dispute and hence is not covered by Section 84 of the Electoral Act.
The fourth defense was that the lawsuit had not been filed in accordance with the law.
Therefore, they requested that the lawsuit be completely dismissed or dismissed with prejudice due to lack of jurisdiction.

The party and others were represented in court, with the exception of INEC’s attorney, who was absent because Wike had lately denied filing any lawsuits against the party and its presidential candidate.
