Court Threatens To Jail Buhari, Lawan, Malami, Lauretta Onochie, Others For Contempt

President Muhammadu Buhari, Attorney General and Minister of Justice Abubakar Malami, Senate President Ahmad Lawan, the Senate of the National Assembly, Mrs. Lauretta Onochie, and Chief Samuel Ogbuku have all received warnings from an Abuja federal high court regarding the repercussions of disobeying a prior restraining order.

President Buhari, Lawan, Onochie, and other parties received a warning from the court on December 23, 2022, in the form of a notice of the repercussions of disobeying a court order.

‘’Take notice that unless you obey the directions contained in this order, you will be guilty of contempt of court and will be liable to be committed to prison,” the notice read.

Additionally, the court barred President Buhari from ordaining Ms. Onochie and Ogbuku.

Last week, the pair were interviewed and approved for the positions of chairman and managing director of the Niger Delta Development Commission, respectively.

The National Assembly’s ability to review and approve the nominations of Onochie and Ogbuku was previously halted by a court injunction.

Justice J. K. Omotosho, the preeminent judge, issued an order suspending any further proceedings awaiting the outcome of the lawsuit.

The originating summons with the file number FHC/ABJ/CS/2294/2022, among other things, requests a restraining order against the National Assembly reviewing and confirming the pair.

The Itsekiri ethnic nationality’s plaintiffs, Chief Edward Ekpokpo Esq., Victor Wood, who is representing the Itsekiri Leaders of Thought, and Mr. Edward Omagbemi, who is presenting Omadino Unity Forum, are contesting the nomination on the grounds that it is their turn to hold the seats.

The NDDC Act’s stipulations must be implemented, according to the lawsuit brought by Ama Etuwewe SAN & Co.

As arguably the largest oil-producing community in Delta State, the Itsekiri ethnic nationality, it was argued, was due to produce the NDDC board chairman and MD.

After reading the affidavit and speaking with the plaintiff’s attorney, Justice J. K. Omotosho, the presiding court, adjourned the case to January 11, 2023, for further hearing.

“That leave is hereby granted to the plaintiffs to serve the 5th and 6th defendants with the originating processes in this suit by substituted means to wit by advertising the processes in at least one national newspaper circulating within the jurisdiction of this to court and to deem the same as proper service.

“That an order is hereby made that no party in this suit shall take any step or act or action that may make the outcome of the pending motion on notice for injunction Dated and filed December 12, 2022, nugatory.

“That any act or step or action taken in this order to make the outcome of the said motion on notice dated and filed December 12, 2022, nugatory shall be a nullity.”

Despite the court’s directive, the Senate confirmed Onochie and Ogbuku as chairman and MD of the NDDC on Tuesday.
