Justice Hamza Muazu of the High Court of the Federal Capital Territory, FCT, Abuja, has given the Department of State Services, DSS, a one-week deadline to either charge or release the imprisoned suspended Governor of the Central Bank of Nigeria, Godwin Emefiele.

The injunction was issued by the Judge on Thursday while delivering a decision in Emefiele’s fundamental human rights complaint against the DSS and others.

Justice Muazu ruled that the DSS has the authority to carry out its constitutional obligations of arrest, imprisonment, and internal crime prevention, but that such duties must be carried out within the confines of the law.

He stated that the DSS’s arrest power was limited to the conditions under which a Nigerian citizen might be detained and for how long.

Emefiele has taken the Attorney General of the Federation, AGF, Director General of the Social Security Service, and the DSS to court, requesting that his fundamental human rights to freedom of movement and dignity in human existence be enforced.

The suspended CBN Governor had requested that his arrest and imprisonment since June 10 be invalidated and set aside in a petition filed on his behalf by a Senior Advocate of Nigeria, SAN, Joseph Daudu.

Emefiele sought N5 million in exemplary damages for his alleged wrongful incarceration.
