UPDATE: US Lawmaker Jarvis Johnson Urges Nnamdi Kanu’s Release

Representative Jarvis Johnson, a Democrat serving in the Texas House of Representatives, has pleaded with the Supreme Court to order Nnamdi Kanu, the leader of the outlawed Indigenous People of Biafra (IPOB), to be released immediately.

The Supreme Court is about to make a decision on two different appeals that the Federal Government and Kanu filed.

Kanu is requesting his release from the Department of State Services (DSS), where he has been detained since his extradition from Kenya on June 19, 2021.

In a statement, Johnson asserted, “The prevailing legal consensus, both within and outside Nigeria, anticipates the Supreme Court’s affirmation of numerous judgments and orders.”

Johnson emphasised the undisputed facts of Kanu’s case, pointing out that he was extradited from Kenya on June 27, 2021, and that he is still the head of IPOB, a nonviolent organisation that supports a referendum overseen by an international body to resolve the Biafran issue inside the Nigerian political system.

Johnson cited the October 30, 2023, ruling of the Enugu State High Court, which ruled that the Government of Nigeria (GON) and the Southeast Governor’s Forum’s designation of IPOB as a terrorist organisation was illegal under Section 42 of the Nigerian Constitution.

He contended that labelling IPOB as a terrorist organisation is unlawful and biassed, particularly in view of earlier rulings from Nigerian courts, such as the Court of Appeals in Abuja and the High Court in Umuahia, Abia State.

Johnson emphasised global issues by pointing on the July 20, 2022, United Nations Human Rights Council ruling denouncing Kanu’s solitary confinement as a breach of international human rights treaties.

The UN demanded his unconditional and immediate release, highlighting the fact that extraordinary rendition is prohibited by both international and Nigerian law.

Johnson concluded by urging the Nigerian Supreme Court to respect the rulings of foreign tribunals and its own lower courts.

He pleaded with the court to grant Mazi Nnamdi Kanu’s immediate and unconditional freedom, claiming that this decision will help rebuild trust in the Nigerian legal system, of which the Supreme Court is the head institution.
