The recent All Progressives Congress (APC) governorship primary in the state has been challenged by Sen. Smart Adeyemi of Kogi West Senatorial District and Shuaibu Abubakar Audu, the son of the former governor.
According to Newsmen, the pair asked an Abuja Federal High Court to annul the primary poll that resulted in Usman Ododo, who is thought to be governor Yahaya Bello’s top choice.
Adeyemi and Audu, respectively, are requesting the court to deem the APC’s alleged primary as unconstitutional, illegitimate, and void for the November governorship election in the lawsuits designated FHC/ABJ/CS/556/2023 and FHC/ABJ/CS/557/2023.

They claimed that the choice of Ododo violated Article 20 of the APC’s constitution, Section 177 of the 1999 Constitution, Sections 29 and 84 of the Electoral Act, and Section 177 of the 1999 Constitution.
Adeyemi asserted in a 35-paragraph affidavit in support of his own original summons that he had paid N50 million for his nomination and expression of interest form, which had cleared him to run in the primary election scheduled for April 14, 2023. He also noted that his senatorial district had never produced a governor.
Therefore, the two candidates are asking the court to issue a declaration that the primary election was invalid.
According to information obtained, Dr. Sanusi Ohiara, a former minister of state for education named Professor Stephen Ocheni, the APC’s deputy national publicity secretary Martala Yakubu Ajaka, and other candidates have already filed lawsuits challenging the results of the Kogi primary.
