LATEST: Kogi State Government Drags Dangote Cements To Court

The ownership of the cement plant at Obajana, a town in the Oworo region of the Lokoja Local Government Area, is the subject of a lawsuit brought by the Kogi State government, headed by Governor Yahaya Bello, against Dangote Industries Limited (DIL), the parent company of Dangote Cement Plc.

An originating summons with the marking HcL/8T/2022 was reportedly attached to the complaint, which was sent to the Kogi State High Court, Lokoja Judicial Division.

The state government asks the court to look into the agreements struck between DIL and the Kogi state government on July 30, 2002, and February 14, 2003, respectively, in the complaint filed on October 18, 2022, in order to determine whether or not the contract included sufficient consideration.

UPDATE: Kogi State To Sue Dangote Over Obajana Cement Plant

If the aforementioned claim is confirmed, the government is also asking the court to void the agreement due to a lack of sufficient consideration, which is a condition for a binding contract.

A perpetual injunction prohibiting Dangote Industries Limited, any of its agents, or assigns from continuing to use and/or benefit from the agreement between the Kogi State Government and Dangote Industries Limited, which was signed on July 30, 2002, and February 14, 2003, is among the requests made by the state government.

In an affidavit submitted in support of the initial summons, the Secretary to the Kogi State Government, Folashade Arike Ayoade, affirms that the Kogi State Government fully registered the Obajana Cement Company in 1992.
