David Umahi, the governor of Ebonyi State, and his deputy were fired on March 8 by a Federal High Court after they switched from the People’s Democratic Party (PDP) to the All Progressives Congress. On Friday, the Court of Appeal in Abuja overturned that decision (APC).
A three-member panel of the appellate court ruled today that a governor or deputy governor who leaves the party on whose platform they were elected is not subject to any penalties under the country’s Constitution.
According to Anaedoonline.ng, Justice Haruna Tsanami of the appellate court stated that the aggrieved political party’s only alternative is to use the constitutional provision for impeachment.

The governor and his deputy left the PDP’s platform, according to Justice Tsanami, and that is the only way the PDP can deal with them.
However, it was noted that the Abuja decision of the Appeal Court mirrored the Enugu decision of the court on the same issue.
