Appeal Court Reserves Judgement In Petition Seeking To Sack Peter Mbah

In an appeal filed by Barr. Chijioke Edeoga, the governorship candidate for the Labour Party in Enugu State, to overturn Governor Peter Mba’s election, the Court of Appeal in Lagos has deferred ruling.

According to Anaedoonline.ng, Mbah was named the election’s victor by the Independent National Electoral Commission, or INEC.

However, the LP candidate filed a petition at the Governorship Election Petitions Tribunal, claiming that Mbah had falsified his National Youth Service Corps (NYSC) certificate because he was unhappy with the election’s result.

On September 21, the tribunal rendered a decision in which it dismissed Edeoga’s petition and upheld Mbah’s election.

But Udeoga took the case to the Appeal Court because he was unhappy with the tribunal’s decision.

Following the parties’ legal arguments, the three-member panel of justices postponed the case to Monday.

The appellate court was instructed by the petitioners’ attorney to strike aside the tribunal’s decision.

The lawyer argued that by dismissing a case of certificate forgery that had been proven, the tribunal presided over by Justice Kudirat Akano committed a legal error, endorsing the heinous act of illegality with a stamp of approval from the court.

The petitioners claimed that in addition to the established case of certificate forgery against Mbah, there were other proved cases of irregularities such as results swapping, computational problems, and overvoting in the Enugu State local government area of Nkanu East.
