The All Progressives Congress (APC) and Tonye Cole’s petition against Siminalayi Fubara’s election as Rivers State governor was denied by the Supreme Court due to its lack of substance.

According to Anaedoonline.ng, the parties to the lawsuit adopted their briefs of argument last week, and a five-member panel led by Justice Kudirat Kekere-Ekun reserved judgement on the appeal.

Tonye-Cole and the African Progressive Party (APC) had appealed Fubara, arguing that the Governor had not resigned as the state’s accountant general by the date set by the Electoral Act and the constitution before running for office in 2023.

Insisting that Fubara lacked the necessary qualifications to even run in the election, let alone be proclaimed the victor by the Independent National Electoral Commission (INEC), is the APC candidate.

Through the appeal, Cole and the APC are attempting to overturn the Court of Appeal’s decision on November 28, 2023, which upheld Fubara’s election.

On Thursday, January 25, the supreme court, however, ruled that the appellant had not proven any of the charges of violating the Electoral Act.

The appeal was rejected by the court after it was determined to be incompetent.
