ROGENNY BATTLES TANSIAN UNIVERSITY OVER N23M DEBT

A debt of N23 million being owed to Chief Rommy Ezeonwuka by the management of Tansian University, have ignited fresh crisis in the university with Ezeonwuka, the proprietor of Rojenny Tourist Centre, Oba, Anambra State, initiating a strong move to take over the Oba campus of the university which, according to him, belongs to his company known as Ranent Industries Nigeria Limited.

The counsel to Chief Ezeonwuka, Barr. A.O Nwankwo, who spoke with journalist on Saturday, said that the failure of the university to pay the said debt to Ezeonwuka, contravenes a consent judgement given by a court of competent jurisdiction in favor of Ezeonwuka and his company, Ranent Industries; when it mandated the university to pay certain amount of money to Ranent Industries.

Barr. Nwankwo recalled that on December 16, 2010, a consent judgement was decided in favor of Ezeonwuka and Ranent Industries in a case with Ref. No. HID/89/2008 at a State High Court, Awka, under Justice J. Anyachebelu.

He explained that the fresh crisis started when the management of the university and the Chancellor of the university, Monsignor JohnBosco Akam, reneged on the annual payment to Ezeonwuka for occupying land belonging to Ranent Industries owned by Ezeonwuka.

His words, “There is a consent judgement from a State High Court presided over by Justice J. Anyachebelu, which was ruled in favour of Ezeonwuka following a case with No. HID/89/2008, mandating the management of Tansian University and Monsignor Akam to pay an amount of money annually to Ranent Industries; but along the line, the management of the university and Monsignor Akam bolted and failed to pay”.

Nwankwo stated that Monsignor Akam gave reasons for his failure to pay based on the ground that the rate of students enrollment into the university have relatively dropped and as a result of that the university could no longer afford to pay the money.

Nwankwo, however, described the claim as untrue as, according to him, the management of the university is using the money being generated from students to build structures at Umunya Campus of the institution.

He noted that following the failure of the school to pay the money as stated in the consent judgement, Ezeonwuka and Ranent Industry filed a motion at the court with No. HID/89M/18 for leave of court to levy execution on the moveable and immovable properties of defaulters/judgement debtors and take over the Ranent Industries where the Oba campus is located.

However, Anaedooline gathered that the management of Tansian University, through their counsel, Barr. E.S Obiora, brought an extant application praying the court to dismiss the motion as, according to him, it constitutes an abuse of process because it is based on a proceeding or decision that is a nullity.

He also requested the court to strike out the entire suit and every proceeding therein as a nullity and vacate or set aside the proceedings, decision, judgement or order made or entered in suit No. HID/89/2008, including the one entered on 16/12/2010; because the said proceeding or decision were a nullity because they were entered without jurisdiction.
