The Federal High Court in Abuja has authorized the hearing of a lawsuit alleging Abubakar Malami (SAN), the Attorney-General of the Federation and Minister of Justice, of abusing his position.
The lawsuit also asks for an injunction compelling the AGF to compensate Cecil Osakwe, a prominent international businessman and property developer, with N1 billion in damages.
The plaintiff testified before the court that the AGF forced him to give Asabe Waziri, a public worker, two units of three-bedroom apartments in one of his properties in Mekong Close, Maitama, Abuja by utilizing his position as AGF.

Osakwe claimed that Malami had forced him to violate an active order of a court with appropriate jurisdiction by giving the property, valued at roughly N130 million, to Waziri.
The plaintiff testified before the court that the AGF intervened in a legal dispute his company had with Waziri and made use of his authority to oversee the ongoing harassment of Waziri by security personnel.
Osakwe said that he sued Malami in both his official and private capacities, alleging that his fundamental rights had been gravely violated.
The plaintiff claims that Malami took the action despite being aware that the second defendant had initially moved into the subject property and remained there for more than eight months before being evicted by a valid court decision that ended the parties’ sales agreement.

In addition to asking the court to rule that the AGF abused his position, the plaintiff sought the court to order him to pay N1 billion.
